Welcome to the Koh Samui Business Portal (the "Portal"). These Terms and Conditions ("Terms") govern your access to and use of our services, including all content, features, and functionality offered through the Portal. By using the Portal, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use the Portal.

1. Acceptance of Terms

By accessing or using the Portal, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Services Offered

The Portal provides a range of services for Businesses and Users:

2.1 For Businesses

  • Paid Business Listings: Businesses can create a paid listing on the Portal for an annual fee.
  • Add-On Categories: Businesses may enhance their visibility by adding categories for an additional yearly payment. If the add-on is done after the original date of listing, the price will be calculated to the same ending date as the main listing.
  • Picture or Logo Upload: The business can add 1 picture or logo to represent their business with a maximum size of 500 KB as a profile picture.
  • Event Posting: Businesses can add events to their listings, with a clear mention of price, date, and time, and up to 4 images.
  • Menu/Price List Links: Businesses can add external links to menus, pricelists that are on their website and/or social media.
  • Discount Promotions: Businesses may offer discount promotions, which must clearly state the discount amount or percentage, starting date and ending date of the promotion, and other relevant information.

  • Choose a Catchy Title: Start by selecting an appealing and descriptive title for your event. This will attract attention and help your event stand out.
  • Upload a Picture with Info: Visuals are key! Upload an engaging picture that represents your event. Make sure it’s clear and high-quality, and add relevant details in the image description.
  • Include Essential Information in the Description: Ensure all the important details of the event (date, time, location, etc.) are included in the event description. This will also help when working with automatic translation tools.
  • Set a Price or Mark as Free: Always include the ticket price or mark your event as free. This helps potential attendees decide quickly and adds clarity to the event listing.
  • Provide Event Date and Time: Clearly state the date and time of your event. This ensures that attendees can easily find out when your event is happening.
  • Provide Reservation Information: If reservations are required, make sure to include clear instructions on how to reserve spots, whether online, via phone, or through another method.

  • Choose a Catchy Title for Your Promotion: Make your discount stand out with an attention-grabbing title. Use words like “Limited Time Offer,” “Exclusive Deal,” or “Huge Savings” to create excitement and urgency.
  • Upload a Picture with Info: A visually appealing image can make all the difference. Upload a high-quality picture that highlights your discount and includes key details. Make sure the text in the image is easy to read and supports the offer.
  • Include Key Information in the Description: In the description, be sure to mention the original price, discounted price, and any relevant terms. This is important for translation tools to ensure your message is clear in multiple languages.
  • List the Normal Price and Discount: Always show both the original price and the discounted price. This will make the discount more obvious and appealing to potential customers.
  • Specify Dates and Times of the Promotion: Clearly state the start and end dates of the promotion, along with the specific times (if applicable). This will help customers know when they can take advantage of the deal.
  • Provide Reservation Information if Necessary: If reservations are required to claim the discount, include detailed instructions on how to reserve, whether it’s online, over the phone, or in person.

Payment Terms and Listing Renewal Policy

All payments are required upfront for a full year and are non-refundable. We will send you a reminder 30 days before your listing(s) expire, giving you the option to renew if you'd like to continue using our services.

If you choose not to renew, you have two options:

  • Switch to a Basic Directory Listing: You can downgrade your listing to a standard, free directory listing.
  • Request Complete Removal: Alternatively, you can request to have your listing fully removed from our platform by sending an email to removal@samuisocial.com.

Please note, the renewal is entirely up to you, and we’ll make sure you have the information you need to make an informed decision before your listing expires.

Samui Social Directory Removal Policy

If you wish to remove your business listing, claim a business that belongs to you but is listed under someone else, or remove a picture or video that belongs to you and is being used without your permission, please follow the steps below:

  • Submit a Removal Request: Send an email to removal@samuisocial.com with the details of your request.
  • Provide Proof of Ownership: To process your removal request, we will require proof that you are the rightful owner of the business listing, image, or video. Please include any relevant documentation or evidence in your email to support your claim.
  • Request Handling: Once your email is received, we will review the request and take action within 30 days. You will be notified about the status and the actions taken regarding your request.

We strive to handle all removal requests in a timely and fair manner, ensuring that your rights are respected and upheld.

2.2 For Users

  • Free Viewing: Users can freely browse and view all businesses listed on the Portal and access general information about Koh Samui.
  • Free Registration: Users must register for a free account, which will be confirmed by email. During registration, users must provide accurate and complete information.
  • Access to Contact Information: Users will have access to contact information, website links, and map locations of businesses.
  • Yearly Paid Subscription: With a yearly paid subscription, confirmed by email, users will gain access to the events calendar, discount promotions, social table features, the ability to add favorite businesses, and personal calendar organization.
  • Non-Refundable Payments: Once a feature has been activated or used, the payment is non-refundable.
  • Recurring Payments: Payments will be recurring unless changed to manual in the settings by the User.

3. User Conduct

Lawful Use: Users agree to use the Portal for lawful purposes only. Any unauthorized use or activity that disrupts the Portal’s functionality is prohibited.

Prohibited Activities: Users agree not to:

  • Misrepresent their identity or affiliation.
  • Post or transmit any unlawful, harmful, or offensive content.

4. Limitations of Liability

No Guarantee of Accuracy: The Portal does not guarantee the accuracy, reliability, or availability of any business listings or services.

Disclaimer of Liability: To the fullest extent permitted by law, the Portal and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Portal or any content therein.

5. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Portal. Continued use of the Portal after modifications constitutes acceptance of the new Terms.

6. Governing Law

These Terms are governed by and construed in accordance with the laws of Thailand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Thailand.
